Teachers' Right to Suspend from Class

As educators, we fully recognize that student suspension in and of itself does not solve safety and behavioral concerns. This is why Ed Code requires a parent-teacher conference to follow as soon as possible. A suspension is sometimes a necessary step in holding the district accountable in supporting educators and documenting incidents appropriately.
SB 274 and Willful Defiance: Research has shown that students of color; students with disabilities; and lesbian, gay, bisexual, transgender, queer, intersex, and asexual students are more likely to be suspended for low-level subjective offenses such as willful defiance and disruption. In response to these equity issues, legislation has been passed, including SB 274, prohibiting suspension and expulsion from school up to 12th grade. SB 274 does NOT take away an educator's right to suspend a student from their class.
